DA wants to prosecute defensive shooting. Grand Jury doesn't agree

Star-Telegram | 06/08/2005 | Teen not indicted for killing his father. A drunk abusive father, who the family was kicking out - all his stuff was on the porch so he wouldn't come in - barges in and threatens his family. He assaulted members of the family and their friends. Casey Morgan put an end to it.
Morgan [the father] shouted "Your time is up" and then lunged at his brother, [Brandt].
That's when Casey decided his father meant it, grabbed a shotgun from his uncle and defended his brother from a 6ft 4in man bent on violence.

But Tim Bednarz, the DA, thinking of his won/lost record and not thinking about justice, decided he should try and prosecute. The Grand Jury saw things clearly. Casey defended his brother, his family, from a very real threat.

Years of threats, and violence against the family, drugs and other problems with the law came before. Death threats, threats to burn down the house with the family locked inside, all came before that final attack on his brother. Casey did a hard thing, but it was the right thing.
